Terms and conditions
These terms and conditions govern all contracts for the creation and maintenance of websites between BYF-Webdesign and its clients.
1. Scope
These terms apply to all contracts with BYF-Webdesign — Mathis Hélan, Strietwaldstrasse 83, 63741 Aschaffenburg, Germany. Deviating terms of the client are not recognised unless expressly agreed in writing.
2. Offer and conclusion of contract
The presentation of services on this website is non-binding and does not constitute an offer in the legal sense. A contract is formed only upon written acceptance of an individual quotation. Quotations are valid for 30 days.
3. Scope of services
The scope of services is set out in the quotation. Subsequent changes or extensions require written agreement and may be charged additionally.
4. Client's duties to cooperate
The client provides the content, materials and approvals required for the work in good time. Delays caused by missing cooperation extend agreed deadlines accordingly.
5. Remuneration and payment
The prices stated in the quotation apply plus statutory VAT. Unless otherwise agreed, a deposit is due at project start and the balance on launch. Invoices are payable within 14 days without deduction.
6. Warranty and acceptance
The client checks the work without delay and reports defects within 14 days. We are entitled to remedy reported defects. Failing a report, the work is deemed accepted.
7. Liability
We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for breach of essential contractual obligations and for injury to life, body or health. Liability for lost profit or indirect damages is excluded.
8. Copyright and rights of use
Upon full payment the client receives the agreed rights of use to the delivered website. We reserve the right to show the work as a reference; the client may object at any time.
9. Confidentiality
Both parties treat confidential information of the other party as confidential and use it solely to perform the contract.
10. Final provisions
German law applies. The place of jurisdiction is Aschaffenburg, to the extent permitted by law. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
